Gonzalez submitted comments to the Federal Register in response to NOAA Fisheries-NMFS’ proposed rule to strengthen and expand the Seafood Import Monitoring Program (SIMP), urging NMFS “to rethink this proposal” since “it upends longstanding commercial practices, impacts the flow of trade and alters the meaning of customs law – with no measurable improvement in SIMP supply chain tracking.”

In a final rule published in the March 20 Federal Register, the Federal Maritime Commission (FMC) changed the language in the Shipping Act that governs potential liability of a violator by adding the phrase “or, in addition to or in lieu of a civil penalty, is liable for the refund of a charge” immediately after the term civil penalty.
